License Agreement

Avaya, or any of its affiliates or subsidiaries, hereby grants to you a nonexclusive license under which you can:

• Use this CD on a single-user personal computer, on a server that is to be used by multiple users within your Company on a local area network, or on your Company's intranet.
• Make a backup copy of this CD as long as the restrictions applicable under this license are enforced in connection with the backup copy.
• Transfer possession of this CD concurrent with the transfer of the associated software and documentation provided that the recipient expressly agrees to the terms of this license.

Under this license you cannot:

• Use, copy, modify, or transfer copies of this CD, except as provided in this license.
• Alter, modify, or adapt this CD software, including but not limited to translating, decompiling, disassembling, reverse engineering, or creating derivative works.
• Make the contents of this CD accessible to the general public (for example, over the Internet).
• Reverse assemble or reverse compile this CD software.
• Sublicense, rent, lease, sell, or assign this CD for monetary consideration, except as permitted under this license.

Warranty

THE CD SOFTWARE AND DOCUMENTATION ARE NOT WARRANTED IN ANY WAY AND ARE PROVIDED "AS IS." AVAYA AND ITS AFFILIATES AND SUBSIDIARIES EXPRESSLY DISCLAIM ANY WARRANTY OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Remedies

Avaya and its affiliates' and subsidiaries' entire liability under this license is as follows:

Avaya will replace defective media with a functionally equivalent CD, or you may terminate your license and destroy all copies of this CD. AVAYA WILL NOT BE LIABLE FOR ANY LOST PROFITS OR LOST SAVINGS, OR ANY INCIDENTAL DAMAGES OR OTHER ECONOMIC CONSEQUENTIAL DAMAGES, EVEN IF AVAYA OR ITS AUTHORIZED SUPPLIER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. AVAYA WILL NOT BE LIABLE FOR ANY DAMAGES CLAIMED BY YOU BASED ON ANY THIRD-PARTY CLAIM.

General

You can terminate your license at any time. Avaya or its affiliate or subsidiary can terminate your license if you fail to comply with terms and conditions of this license. In either event, you must destroy all your copies of this CD. Neither party can bring action, regardless of form, more than two years after the cause of action arose.

If you acquired this CD in the United States, this license is governed by the laws of the State of New Jersey. Otherwise, this license is governed by the laws of the country in which you acquired the CD.
