Problem is independent of CM,SM release and also will be present on earlier 96x1 SIP firmwares.

Problem Clarification

9641 SIP phone with 2 call appearances, both having a call ie one on hold other is active and user wants to transerf/conference these calls then it fails.  Same works on One-X Communicator, and other 3rd party SIP endpoints as well.
 

Cause

Working as designed.

-One-X Communicator is able to make the transfer even if it has only 2 call appearances
-96x1 SIP hardphones get denial from CM: 403 Forbidden (no more call appearances)

96x1 SIP stations use re-INVITE for transfer whereas One-X Communicator and other 3rd party SIP clients use REFER method. re-INVITE needs an extra free call appearance to complete the transfer.

Solution

Avaya is changing this design and next GA 6.3 SIP firmware for 96x1 stations will be able to complete the transfer with having only 2 call appearances (last can be restricted as well). So the solution at the date of creation of this article (2013 June 27) is to wait for SIP 6.3 GA to be released for 96x1 and upgrade stations.
